Overview:

The subject of the Food Safety is in the concurrent list of the constitution. However, in general, the enforcement of the Act and redressal of complaints are done by the State / Union Territory Governments. The Central Government primarily plays an advisory role in its implementation of the Act. If any person manufactures for sale, stores, imports for sale or distributes any article of food which is adulterated or misbranded, he is liable under the Prevention of Food Adulteration (PFA) Act, 1954 to be punished with imprisonment and fined.
The main objectives of this legislation are as follows:-

  1. • To protect the public from poisonous & harmful foods.
  2. • To prevent the sale of sub standard foods.
  3. • To protect the interests of consumers by eliminating fraudulent practices.


The Food Safety and Standards Act, 2006:


The Food Safety and Standards Act (FSSA), 2006 enacted by Parliament in August 2006, the Prevention of Food Adulteration Act, 1954 and six Orders relating to food will stand repealed, from the date on which FSSA comes into force on such date as the Central Government may, by notification in the Gazatte appoint.   • Adulteration of ghee, milk, pulses
  • Adulteration of spice powders
  • Sale of packaged food articles after expiry of best before date.

Tier I: Shopkeeper / manufacturer
Tier II: Local Health Authority of District or Commissioner of Food Safety of the State/ Union Territory
Tier III: Consumer Forum
